Abstract

This article explores the legal elements of the right to vote in the context of disability. The analysis emphasizes the legal obligations of States to ensure the accessibility of voting procedures, materials, and polling stations in light of international human rights law and, in particular, Article 29(a) of the Convention on the Rights of Persons with Disabilities (CRPD). The main argument is that ensuring the accessibility of elections, including the availability of assistive electoral technologies for voters with disabilities, constitutes a legal obligation of States Parties to the CRPD, such as Colombia. Based on a legal analysis of relevant international legal instruments, including the International Covenant on Civil and Political Rights (Article 25(b)) and the CRPD (Article 29(a)), the study concludes that the availability of technological resources is a positive measure that States Parties to these instruments may adopt to ensure equal opportunities in the electoral process and combat discrimination against persons with disabilities in elections.
