Abstract
This article analyzes the mechanisms that shape the legal framework of the technology transfer process in Chile, with a particular focus on the foundations of the legal protection strategy within this context. To achieve this, it is essential to have a clear and efficient regulatory framework that facilitates collaboration between the public and private sectors, ensures the protection of intellectual property, and fosters an environment of trust and innovation within the national ecosystem. The effective integration of actors in Chile’s innovation ecosystem requires strengthening the relationship between universities, businesses, and the state, ensuring a balance between intellectual property protection and open-access knowledge dissemination. This balance is crucial to driving technological development and national competitiveness without undermining the interests of inventors. The research employs dogmatic and comparative legal methods, complemented by document analysis techniques. Additionally, two key approaches are identified to enhance the integration of these mechanisms: first, technology transfer should not be limited to commercialization but should also include its effective application in new products and processes; second, legal protection must be considered a strategic component of the process, considering the diversity of typologies and legal challenges that may affect the transfer of technology and knowledge.
