Abstract
La investigación se encuadra dentro del marco teórico del Derecho Electoral, como sector del área de conocimiento de Derecho Constitucional. El derecho de sufragio es un elemento arquitectural básico de la cláusula constitucional de Estado democrático.
El derecho de sufragio es un derecho subjetivo pero es también una pieza clave en el marco de dicha cláusula de Estado democrático en la medida en que sin elecciones y, por consiguiente, sin derecho de sufragio, no es posible la renovación y consiguiente continuidad del sistema institucional sobre el que descansa una democracia. A lo anterior ha de añadirse que la participación a través de referéndum constituye también actividad electoral que tiene igualmente como presupuesto el reconocimiento y la protección jurisdiccional del derecho de sufragio
