Abstract

Following international practice related to military operations against Daesh, part of the doctrine has argued that silence regarding a publicly announced but uncontested intervention can be considered a legal basis for conducting military assistance. Thus, using a hypothetico-deductive methodology, this article examines the Syrian case to frame the legal issue and, from there, analyzes the matter based on international law sources, international case law, and relevant doctrinal contributions. The study seeks to determine whether the silence of a State’s Government, upon notification of a military intervention by another State, can be interpreted as tacit consent. The article concludes that there are grounds in international law to support this interpretation,
provided there is clear prior notification that compels the Government of the State where the intervention will take place to take a position, thereby, eliminating any doubt. However, the article expresses caution regarding its application, because it affects a central area of international law, such as the use of force.
